These Online Terms of Use govern your access to www.abbviecare.ie. Please read these Online Terms of Use and the Privacy Policy carefully before you start to use our site, as these will apply to your use of our site. We recommend that you print a copy of this for future reference.

Terms of Use for www.abbviecare.ie

These Online Terms of Use only apply to www.abbviecare.ie (“AbbVie Website”) and do not apply to any other AbbVie websites, or to third party websites to which the AbbVie Website may link.

Without prejudice to your rights under applicable law, AbbVie reserves the right to amend these Online Terms of Use at any time (including, without limitation, to reflect technological or functional advancements, legal and regulatory changes or good business practices). If AbbVie amends the Online Terms of Use, we will notify users by posting the amended version with an updated effective date on this AbbVie Website. By accessing or using the AbbVie Website, you agree to be bound by the then current version of the Online Terms of Use. If you disagree with these Online Terms of Use, or are dissatisfied with the AbbVie Website, your sole and exclusive remedy is to discontinue using the AbbVie Website. 

In order to use the AbbVie Website, you may be asked to furnish information that constitutes an electronic signature.  You accept that your electronic signature is legally binding and equivalent to your written signature. You agree that after your authentication for use of an AbbVie Website, both (i) your act of ticking any checkbox on a form to indicate consent, or (ii) your use of functionality of the AbbVie Website, constitute “electronic signatures” within the meaning of the Electronic Commerce Act 2000, and manifest your intention to consent (in particular, to the data collection, handling or disclosure to which such “checkbox” or website functionality may relate, in accordance with the Privacy Policy).

Your Use:

The AbbVie Website is to be used by AbbVie-approved residents of Ireland only.

You agree:

  1. not to disrupt, amend or intercept information posted on the AbbVie Website or on any of AbbVie’s servers;
  2. to provide only information that is accurate, complete and not misleading;
  3. to abide by all applicable, national and international laws, rules and regulations;
  4. not to attempt to circumvent any security features of the AbbVie Website;
  5. not to use the AbbVie Website if you are not at least 18 years old;
  6. not to permit any other person to use your account (failing which, you assume full responsibility for those persons’ use of the AbbVie Website, and further acknowledge that such use is unauthorised and shall constitute a material breach of these Online Terms of Use);

AbbVie does not knowingly collect or use any personal information from children (we define "children" as minors younger than 18) on AbbVie Websites.  We do not knowingly allow children to communicate with us, or use any of our online services.  AbbVie does not have the technical means to guarantee that children will not access and use the AbbVie Websites.  AbbVie therefore invites the holders of parental authority to ensure that their children do not use the AbbVie Website; any use by a child is performed under the full responsibility of holders of parental authority.

AVAILABILITY:

AbbVie will try to make the AbbVie Website available 24 hours a day, 7 days a week. However, we cannot guarantee this and take no responsibility for any loss or damage that occurs due to an interruption of access to the AbbVie Website. AbbVie may interrupt the AbbVie Website for maintenance reasons and will endeavour to provide reasonable notice of any planned events.  You are responsible for making all arrangements necessary for you to have access to our site.

AbbVie also reserves the right to disable or delete your account without delay or formality, in the event of your non-compliance with these Online Terms of Use or the Privacy Policy, if you discontinue treatment for any reason, or if you become a resident of another country in which the AbbVie Website is not explicitly offered.

AbbVie also reserves the right to suspend or terminate the AbbVie Website and/or to terminate these Online Terms of Use upon reasonable notice, at its sole discretion.

Intellectual Property:

The information, content and graphics published on the AbbVie Website (the "Information") are owned by, or licensed to, AbbVie. We grant you permission to use the Information, provided that:

(i) the above copyright acknowledgement appears on all copies;

(ii) use of the Information is limited to informational, non-commercial healthcare or personal use only;

(ii) the Information is not modified in any way; and

(iv) no graphics available from the AbbVie Website are used separate from the accompanying text.

For all other uses of the Information or any AbbVie trademark, trade names or trade dress, AbbVie’s prior written authorisation is required.

AbbVie is not responsible for content provided by third-party providers and you are prohibited from distributing such material without the permission of the owner of the copyright therein.

Except as permitted above, no licence or right, express or implied, is granted to any person under any patent, trademark, copyright, database right or other proprietary right of, or licensed to, AbbVie.

Uploading content to our site:

Any content you upload to the AbbVie Website will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the AbbVie Website a perpetual, worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that content.

We reserve the right to disclose your identity to any third party who is claiming that any content uploaded by you to the AbbVie Website constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of the AbbVie Website.

We reserve the right to remove any content you upload to the AbbVie Website, particularly if we consider, in our absolute discretion, that such content may cause harm or legal liability to AbbVie or to any third party.

The views expressed by other users on the AbbVie Website do not represent our views or values.

Privacy and Security:

AbbVie is committed to safeguarding your privacy, as set out in the Privacy Policy.

It is your responsibility to ensure that the device used to access the AbbVie Website is adequately secured and protected against malicious software or access by unauthorised persons.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party without our explicit permission.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at AbbVie Ireland, Block B, Liffey Valley Office Campus, Quarryvale, County Dublin.

To the maximum extent permitted by applicable law, AbbVie shall not be liable for any direct, indirect, special, incidental, or consequential damages (including lost profits, whether arising directly or indirectly) suffered by any person as a result of interception or unauthorised access to their Personal Data (as defined in the Data Protection Act 1988), even if AbbVie has previously been advised of the possibility of such damages.

The functionality of the AbbVie Website is dependent on the use of internet ‘cookies’, as further described in our Cookie Policy.  Your acceptance of such cookies is therefore a condition of using the AbbVie Website.

Limitation of Liability:

Except in the case of death or personal injury caused by AbbVie’s negligence, AbbVie, its vendors, their respective directors, employees and agents (hereinafter "AbbVie parties") hereby disclaim, to the maximum extent permitted by applicable law, liability for any loss or damage which may be suffered by any person, whether suffered directly, indirectly, immediately or consequentially, and whether arising in contract, tort (including negligence) or otherwise which arises out of, or in connection with: (i) use of, or inability to use, the AbbVie Website; (ii) use of information or content on the AbbVie Website; (iii) any services provided on or through the AbbVie Website; and (iv) interception or unauthorized access to personal information submitted to the AbbVie Website, including, without limitation, the following categories of loss or damage, whether or not AbbVie has been advised of the possibility of such loss or damage: (a) loss or corruption of data; (b) loss of profits; (c) loss of anticipated savings and/or financial loss; (d) loss of business opportunity;(e) loss of goodwill; (f) loss of reputation; and (g) special damage.

Governing law

Any dispute relating to these Online Terms of Use, their subject matter and/or their formation, the Privacy Policy, or any non-contractual disputes or claims, shall be governed by and construed in accordance with the law of Ireland. Any such dispute shall be subject to the exclusive jurisdiction of the courts of Ireland.

General:

You agree that these Online Terms of Use, together with the terms of any Enrolment Letter which you have been provided with, describe the entire agreement between us with respect to its subject matter.

If any provision of the agreement between us is held to be unlawful, void or unenforceable for any reason, such provision shall be deemed severable from the other provisions hereof and invalidity, its illegality or unenforceability will not affect the validity and enforceability of any remaining provisions.
